1. Introduction
Welcome to TheFoodix (“TheFoodix”, “we”, “our”, or “us”). These Terms of Service (the “Terms”) govern your access to and use of the TheFoodix platform, including our website (thefoodix.in), dashboards (app.thefoodix.in), public guest menu pages, APIs, and any related services (collectively, the “Service”).
By creating an account, accessing, or using the Service you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.
2. Our Service
TheFoodix is a multi-tenant software-as-a-service platform that helps restaurants run QR-code-based digital menus and receive orders in real time. Through the Service, restaurants can:
- Create digital menus and generate QR codes for their tables
- Accept and manage guest orders with a live kitchen display
- Access analytics, team management, and guest-menu branding tools
- Subscribe to paid plans through supported payment processors
Guests use the Service to browse a restaurant's menu and place orders without creating an account. TheFoodix is a technology provider; we do not prepare, deliver, or fulfil orders.
3. Eligibility & Your Account
You must be at least 18 years old and have the legal capacity to enter into a contract to use the Service. If you register on behalf of a business, you represent that you have authority to bind that business to these Terms.
When you register, you agree to:
- Provide accurate, current, and complete information
- Keep your login credentials confidential
- Accept responsibility for all activity that occurs under your account
- Notify us promptly at support@thefoodix.in if you suspect unauthorized access
We may refuse, suspend, or close accounts that violate these Terms or contain inaccurate information.
4. Subscription Plans & Billing
TheFoodix offers Free, Pro, and Business subscription plans with different features and usage limits (including the number of tables, staff seats, and daily orders). Current plan details and pricing are shown on our pricing page and within the dashboard.
- Payment processors. Paid subscriptions are billed via Stripe (international, USD) or Razorpay (India, INR). By subscribing you also agree to the terms of the applicable processor. We do not store your full payment card details.
- Renewal. Paid plans renew automatically at the end of each billing period unless you cancel beforehand.
- Cancellation. You may cancel at any time from billing settings. Your plan remains active until the end of the current billing period, after which your account downgrades to the Free plan.
- Refunds. Fees are non-refundable except where required by applicable law.
- Taxes. Displayed prices may exclude applicable taxes; you are responsible for taxes imposed on your transactions.
- Changes. We may change pricing or plan features with at least 30 days' advance notice. Continued use after the change takes effect constitutes acceptance.
5. Restaurant Obligations
If you use the Service as a restaurant owner or staff member, you are solely responsible for:
- The accuracy of your menu items, prices, descriptions, images, and dietary or allergen information
- Compliance with all applicable food safety, hygiene, licensing, tax, employment, and consumer-protection laws
- Fulfilment of orders placed by guests, including quality, safety, and timing
- Handling guest complaints, refunds, and disputes arising from orders
- Ensuring you have the rights to upload all content, including logos, images, and menu descriptions
6. Guests & Orders
Guests place orders through QR-code-linked menu pages. Each order is a direct commercial transaction between the guest and the restaurant. TheFoodix is not a party to that transaction and is not liable for the preparation, quality, safety, or delivery of food or beverages.
Restaurants are responsible for providing accurate pricing (including any taxes), for promptly confirming or rejecting orders, and for any warranties made to guests.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Service, other accounts, or any connected system
- Interfere with, disrupt, or circumvent security, rate limits, or tenant-isolation mechanisms
- Reverse engineer, decompile, or derive source code except as permitted by law
- Use the Service to send spam, malware, or otherwise harmful code
- Scrape, mirror, or extract content in bulk without our written permission
- Impersonate any person or entity, or misrepresent your affiliation
- Resell, sublicense, or white-label the Service without written authorization
8. User Content & Intellectual Property
“User Content” means any content you upload or transmit through the Service, including menu items, descriptions, images, logos, themes, and guest-facing text.
- You retain ownership of your User Content.
- You grant TheFoodix a worldwide, royalty-free, non-exclusive licence to host, reproduce, display, and transmit your User Content solely to provide and improve the Service.
- You represent that you own or have the necessary rights to all User Content you submit.
- The Service itself — including software, design, logos, and trademarks (excluding your User Content) — is owned by TheFoodix and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.
9. Third-Party Services
The Service integrates with third-party providers such as Stripe, Razorpay, Google, GitHub, Resend, Supabase, and Upstash. Your use of those features may be subject to each provider's own terms and privacy policies. We are not responsible for third-party services we do not control.
10. Termination & Suspension
You may terminate your account at any time by cancelling your subscription and requesting account deletion. We may suspend or terminate your account — with or without notice — if:
- You breach these Terms
- Your use poses a security, legal, or financial risk
- We are required to do so by law or by a payment processor
On termination, your access to the Service ends and your data is handled in accordance with our Privacy Policy, subject to applicable legal retention requirements.
11. Disclaimers & Limitation of Liability
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.
To the maximum extent permitted by law:
- We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, or goodwill.
- Our aggregate liability arising out of or related to the Service will not exceed the total fees paid by you to TheFoodix in the twelve (12) months preceding the event giving rise to the claim, or INR 10,000, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless TheFoodix and its officers, directors, employees, and contractors from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your User Content
- Orders or interactions between you and guests or other users
- Your violation of any third-party right or applicable law
13. Governing Law & Disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra for any dispute arising out of or relating to these Terms or the Service, except where applicable law requires otherwise.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you should stop using the Service before they take effect.
